1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the Fanpit platform, including our website, mobile applications, and all related services (collectively, the "Service") operated by Fanpit Technologies Private Limited ("Fanpit," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

Age Requirement: You must be at least 18 years old to use our Service. By using our Service, you represent and warrant that you are at least 18 years old.

2. Service Description

Fanpit provides a comprehensive customer operating system that includes:

  • Loyalty Platform: Digital loyalty programs for businesses with FanScore and FanPoints systems
  • Marketing Automation: AI-powered marketing tools and customer engagement systems
  • Event Ticketing: Event discovery, ticket sales, and event management services
  • Conversational AI: Customer service automation and business communication tools
  • Customer Intelligence: Analytics and insights for business operations
3. User Accounts and Registration

To access certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Event Ticketing Services

Ticket Sales: When you purchase tickets through our platform, you enter into a contract with the event organizer. Fanpit acts as a ticketing agent and is not responsible for the event itself.

Service Fees: We may charge service fees for ticketing services, which will be clearly disclosed during the booking process before payment. Service fees, where applicable, are non-refundable unless specifically stated otherwise.

Event Information: We rely on event organizers to provide accurate event information. We are not responsible for changes to event details, cancellations, or postponements.

Ticket Delivery: Tickets will be delivered via email or made available in your Fanpit account. You are responsible for presenting valid tickets for event entry.

Cancellation and Refunds: Cancellation and refund policies are determined by individual event organizers and will be clearly displayed on each event page. Fanpit's refund obligations are limited to our service fees, where applicable.

Resale Restrictions: Tickets may not be resold above face value unless explicitly permitted by the event organizer. Unauthorized resale may result in ticket cancellation.

5. Loyalty Program Terms

FanPoints and FanScore: Our loyalty system includes FanPoints (platform-wide currency) and FanScore (brand-specific scores). FanPoints earn at a rate of 1 point per ₹100 spent and redeem at 1 point = ₹1.

Point Expiration: FanScore expires annually. FanPoints do not expire but may be subject to account inactivity policies.

Redemption: Points can be redeemed through our marketplace subject to availability. We may charge a commission of 10–20% on marketplace transactions, which will be clearly disclosed before redemption.

Program Changes: We reserve the right to modify loyalty program terms with reasonable notice to users.

6. Business User Obligations

If you are a business using our platform, you additionally agree to:

  • Provide accurate business information and maintain current contact details
  • Comply with all applicable laws regarding customer data and marketing communications
  • Honor loyalty program commitments and reward redemptions
  • Provide accurate event information and honor ticket sales (for event organizers)
  • Pay all applicable fees and charges on time
7. Payment Terms

Payment for our services is due according to the billing terms specified in your service plan. We may suspend or terminate services for non-payment.

For event tickets and other transactions, payment is processed through our third-party payment processor, Razorpay, at the time of purchase. We are not responsible for the actions or omissions of payment processors, but will assist in resolving payment-related issues.

8. Data and Privacy

Your privacy is important to us. Our Privacy Policy, which forms part of these Terms, explains how we collect, use, and protect your information. By using our Service, you consent to our data practices as described in our Privacy Policy.

You grant us a license to use, store, and process the data you provide to deliver our services and improve our platform.

9. Artificial Intelligence and Automated Processing

Our Service uses artificial intelligence and automated systems to provide customer insights, conversation management, and personalized experiences. By using our Service, you consent to automated processing of your data for these purposes.

10. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose or to violate any laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Transmit viruses, malware, or other harmful code
  • Harass, abuse, or harm other users
  • Misrepresent your identity or affiliation
  • Interfere with or disrupt the Service
  • Attempt to manipulate loyalty points or game our systems
  • Resell tickets in violation of event organizer policies
11. Intellectual Property

The Service and its original content, features, and functionality are owned by Fanpit Technologies Private Limited and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you submit to our platform but grant us necessary licenses to provide our services.

12. Disclaimers and Limitation of Liability

Our Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Fanpit Technologies Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses.

For event ticketing, our liability is limited to the service fees charged by us, if any. We are not responsible for event cancellations, changes, or the actions of event organizers.

We will acknowledge your grievance within 24 hours and endeavor to resolve it within 7–10 business days.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any breach of these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service will cease immediately, but provisions regarding liability, indemnification, and dispute resolution shall survive.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through our platform. Continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
